2017 Legislative Session

The 2017 Nevada Legislature kicked off its 120-day session yesterday. There are a lot of bills up for consideration. Anyone have any bold predictions about what we will see become law out of this session? Any bills that the legal community in particular should be watching?

Also, on of our readers wants to know how to get into the lobbying business in Carson City. Any pointers?

  1. Tort claim immunity and caps on damages - big insurance is hard at work.

    1. No chance on either of those passing. Aaron Ford is in control. The insurance lobby had their only chance last session.

    2. Aaron Ford is in control? You mean Robert Eglet is in control!
Everyone knows that Aaron and his wife couldn't do anything with their JD's and their minority status in a much more diverse and powerful Texas judiciary, and so they appear on the Vegas legal scene and backed with Bob's money and all of a sudden are doing just quite nicely for themselves. No, I'm not a Republican! No, I didn't vote for Trump!
Just calling it how it is!

    3. Agree with 1:08, Ford is just a paid for private professional legislator hiding behind his law degree and his non-equity partner status @ E&P.

    4. Seems to me Bob has it all sewn up. Control of RJC judges, majority leader in State Senate. What area of law does Aaron Ford practice for Eglet & Prince? Certainly, it's not PI as I have never seen him listed as counsel for a Motion, appearance in a hearing etc. I can only guess that his position as partner is one of legislator/personal lobbyist in law bill passage or law bill denial at the state level. Anyone have any legal reference for Ford actually practicing law at Eglet?

    6. 1:24, the term you're searching for is "window dressing"

    7. Aaron Ford is big on CCSD board issues ... mostly advocate for issues that have a threat to teacher's union objectives.

    8. So many insurance defense peeps hating on Ford/Bob...y'all just can get over getting your asses kicked eh? Go get your own "front man" then..oh wait you already have one in Hutchinson

    9. A-16-738799-C is a case where Ford is listed as counsel at Eglet's office. It is a personal injury/construction defect case.

    10. Insurance defense lawyers should rightly love Ford/Bob. Insurance companies should rightly fear Ford/Bob.

If you're an insurance defense lawyer and you don't yet understand that what's good for Bob is good for you, sit and think about it for a moment. Better yet, go have one of the partners explain it to you. And after you understand, don't tell the insurance company people who send work to you.

  2. Newbie question: defendant files ans/cc - does plaintiff file Motion to Dismiss counterclaims before or after her reply to counterclaim? Thank you for any help

    1. You can file that Motion to Dismiss before you file that answer sweetheart.

    2. Look at NRCP 12(b). It lists out defenses that have to be made before filing a pleading. So, the answer depends on the basis for your motion to dismiss. If you do it after you've filed your Reply, then you would need to do a motion for judgment on the pleadings. However, per 12(h)(3), if the court doesn't have subject matter jurisdiction it can dismiss the case at any time.

    3. Did you sleep through Civil Procedure? If someone files a counter/third-party claim, all of the same rules relating to pleadings and Rule 12 motions apply, just as they would apply to P v. D.

  3. Are the rumors true that there will be a bill introduced as to raising the minimum policy limits for auto insurance (liability) from $15,000 to $25,000?

    1. Make $15k auto med-pay mandatory like most other states!

  4. 864 BDRs. Let that sink in. Eight Hundred and Sixty Four separate bill draft requests for a Legislature that meets for 120 days, every other year. And people want this bunch of clowns to go full-time?

    1. 10:21- Full time Nevada Legislature. Nope. You know what they say, "No one is safe while the Legislature is in session" and that was said by Mark Twain about the Nevada Legislature. Our only hope is gridlock otherwise we will get crazy bills like the stadium.

    2. Everything, from the minor and mundane to the grand and complicated, must start as a bill draft request. It'll be around 1300 by the end of session, and that's fairly typical for a legislative session. The number of BDRs that can be requested is generally capped, precisely because o the 120-day limit for regular legislative sessions.

Of the BDRs, usually around 1000 actually get introduced, again fairly typical.

    3. And by the end of the session, 100's more will be filed. Keep it at 120 days every 2 years.

  7. Who you people?

Your website exudes a pathetic cataclysm of hate, judgment, bullying, ignorance, revenge, and paranoia.

As a website administrator and publisher and lawyer, your narrative speaks of an acute form of psychopathy, James E. Smith (Joseph W. Law).

Have you apologized to Adam Kutner yet? Is he even aware that you administered the former WildWildLaw website and that your cohort writer "Elle Woods, Esq.” is really Danielle Blackham Liss?

All of the unrelenting abuse you perpetrated against Adam Kutner on the Wild Wild Law blog was cruel, highly unprofessional, and quite disturbing coming from members of your own so-called profession.

You caused Kutner to sue Google (which is quite laughable really) and make fools of your entire profession locally.

Clearly, the legal profession in Las Vegas suffers greatly from incompetency, low self-esteem, and an unstoppable desire to perpetrate fraud on many levels.

Just to mention a few; you've experienced Judge Halverson and her embarrassingly bizarre actions, your Honorable Steven E. Jones who scammed millions, associated with the underbelly of society, killed his accomplice girlfriend and successfully covered it up, now serving a Federal Prison sentence.

Oh, and lets not forget Robert Graham, your most recent example of Honorable Justices in Las Vegas.

Oh, and Justice of the Peace Melanie Andress-Tobiasson providing the "Power Monger" status to complete this absurdly disturbing picture.

In my opinion, you're all a bunch of money grubbing, insecure, paranoid, untrustworthy, not to be trusted wind bags!

    You should ALL be ashamed!!

    4. 3:45, you are giving this dude way too much credit. 2:35, put your tinfoil hat back on and shut the fuck up. I practice here and in California and both states are equally fucked up. But I'd rather live in both than anywhere else. We, CA and NV, vote democrat, have actual plaintiff's rights, contribute more to the economy that any red state, and we're not a bunch of fucking right wing hypocrites. Kutner's a douche, who cares who published blogs and our judges are our friends and they're fucking awesome. Go back to whatever survivalist hole you crawled out of and leave us our drugs, strippers and 24 hour life.
