Eye For An Eye

Remember Senator Harry Reid's black eye and the controversy over whether it was really the result of an exercise accident or courtesy of his brother's nasty right hook? Well, it looks like the angry brother theory is busted since Senator Reid decided to sue the manufacturer of the TheraBand that either broke or slipped out of his hand and injured his right eye.  Reid and his wife, as plaintiffs, are represented by James M. Morgan (interestingly enough, an Orange County attorney at a firm specializing in elder abuse). They are suing the Hygienic Intangible Property Holding Company; Hygienic Corporation; and Performance Health LLC in the Eighth Judicial District Court in Nevada. The matter is assigned to Judge Joe Hardy with case number A-15-725704-C. The Reids' complaint alleges damages in excess of $50,000 (meaning this was not properly pleaded under Nevada rules) and includes a cause of action for loss of consortium.  You can see a copy of the complaint here.

  1. The bands scare me. I personally know of two major injuries as a result of these things. Stick to weights and kettleballs if you want a safe workout. "Consortium" with the wife, if done with proper vigor over a reasonably long course of time, can do more for your core than 100 sit ups, with a pleasant after glow.

    2. You definitely have to be a Boyd 2012-2013 grad if you are defending Reid. He is such a jerk.

  4. Suvinder Ahluwalia (a partner with Sklar Williams) passed away unexpectedly the other day. He was around the age of 50. Very tragic. May he rest in peace.

    3. Can anyone confirm whether or not he passed away? His profile is still up at SW. I sincerely hope this rumor is false. Good guy, good lawyer.

    5. Does anyone know for sure that it was a heart attack. Don't think he was a smoker. Did he have any symptoms or warning signs?

    6. I haven't really seen or dealt with him in 15 years or so. Did he leave a family? I hate to say it, but this profession is not healthy for men in their 50's. This is at least the third or fourth sudden premature death in the last few years.

    7. Troubling blog item and even more troubling comment above because I'm 52 and still at the office right now working on an opposition to an msj, having started my day at 4 a.m.

    9. Very decent person to deal with. Always thought he was a real professional on the few cases I dealt with him.

  5. Can someone who deals with this kind of stuff tell me if loss of consortium is strictly sexual or does it include loss of companionship, doing the dishes, etc?
