Best Response to a Cease and Desist EVAR!

I'm a big fan of over-reaching attorneys being put in their place, which is why I loved this story so much. It appears that there is more than one brewery/pub in America that uses the term Hopasaurus Rex to describe a variety of beer (although the letter clarifies this issue a bit). One of the breweries, the Steelhead Brewing Co., is located in Eugene, Oregon and the other, Freetail Brewing Co., is in San Antonio, Texas.

Well Steelhead couldn't handle the fact that Freetail was using the "Hopasaurus Rex" phrase to describe its beer, so it did what any other red-blooded American would do: LAWYER UP! Steelhead's attorney sent a cease and desist letter to Freetail, and received the following (awesome) response:

I wish all disputes could be resolved like this. But then again, why would anybody want to avoid paying legal fees, amirite?

  2. And the attorney in Oregon who thinks he can enforce trademark rights for a product never advertised, sold or otherwise known of in Texas doesn't have a clue about trademark law.
