Rule 5.3(c)(2) says, "A lawyer shall be responsible for conduct of such a person [nonlawyer employed by lawyer] that would be a violation of the Rules of Professional Conduct if engaged in by a lawyer if:(2) The lawyer is a partner or has comparable managerial authority in the law firm in which the person is employed, or has direct supervisory authority over the person, and knows of the conduct at a time when its consequences can be avoided or mitigated but fails to take reasonable remedial action.<br /><br />Rule 1.8(j) says "A lawyer shall not have sexual relations with a client unless a consensual sexual relationship existed between them when the client-lawyer relationship commenced. I recently received an e-mail from my paralegal that was not intended for me, but for a client of mine. <br /><br />The e-mail had a tone that made me think that there was more than just a client-paralegal relationship budding between the two of them. Instead of going in to quickly confront my paralegal, I decided to do a bit more investigation. As is my right, I read through the firm e-mails that the paralegal had sent/received from this client.<br /><br />It appears that my paralegal is engaged in an extra-marital affair with this client. I'm not going to get on my high horse and judge my paralegal for doing this(even if I am morally against it), I'm just worried about the effects it will have on my firm. <br /><br />I'd like some advice on how to handle this situation. Are there any Professional Rules I should be concerned about? Any advice is welcome.Anonymousnoreply@blogger.com
